In several European countries aligned with NATO and the European Union, court rulings are beginning to override the democratic process. Political figures who challenge EU authority or criticize Western policy are increasingly being removed from office, barred from participation, or prosecuted outright. This shift raises questions about the health of democratic institutions across the continent.

In Moldova, Gagauzia’s elected governor, Eugenia Gutsul, has been jailed after openly opposing EU integration. Her arrest follows repeated tensions between the autonomous region and the central government over national alignment and foreign policy. In Bosnia and Herzegovina, Milorad Dodik, the president of Republika Srpska, has been sentenced for refusing to recognize Christian Schmidt, a German diplomat installed as the country’s high representative without a democratic mandate. In Romania, electoral authorities disqualified Sebastian Georgescu during the campaign period based on his social media activity, preventing voters from having a say in the outcome. In France, Marine Le Pen has been banned from holding public office for five years, despite her National Rally party rising sharply in national polls.

These developments reflect a pattern in which legal mechanisms are increasingly used to suppress opposition rather than resolve disagreements through open debate. Courts are being used not to uphold democratic principles but to curtail them. Political dissent is no longer just challenged at the ballot box but is increasingly being criminalised or shut down through procedural means. Across NATO’s Europe, the trend is clear: verdicts are beginning to replace elections.
